Right to Light

In recent years, the concerns raised by the possibility of a Right to Light claim against a proposed development have risen to the top of the risk register.  BVP regularly acts for developers in city centres nationwide.  Recent case law has confirmed the importance of ensuring that advice is given at the earliest possible stage of design development.

Thereafter, the developer and architect can be helped by defining Right to Light contours, massing models, compensation budgets and interpretation of the law.

Similarly, BVP advise adjoining owners who believe they will suffer a loss or are aware that a development is causing a significant loss of sky visibility.  Again, due to a combination of the specifics and vagaries of the law, advice should be sought as soon as possible.
